These Terms of Service ("Terms") govern your access to and use of Hermetic Trader — including the Vigil journal and the hermetictrader.com website (together, the "Service"). By creating an account, starting a trial, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you confirm that you meet these requirements and that the information you provide is accurate.
A subscription provides access to the Vigil journal, including its analytics and, where offered, the shared Desk feature, and related materials. We may add, change, or remove features over time as the Service evolves.
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at hello@hermetictrader.com if you believe your account has been compromised. You are responsible for the accuracy of the information in your profile.
While your subscription is active, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own trading and study. You may not, and may not permit others to:

The Service, including the software, text, design, and the names "Hermetic Trader" and "Vigil," is owned by us and protected by intellectual-property laws. Except for the licence in Section 7, these Terms grant you no rights in our intellectual property.
Your journal entries, trade logs, notes, and model belong to you. You grant us only the limited licence needed to host, process, back up, and display that content back to you in order to operate the Service. We do not sell your content, and we do not use it for advertising or model training. Our handling of your data is described in our Privacy Policy.
The Service relies on third parties — including Stripe, Supabase, and Cloudflare. Your use of those services may be subject to their own terms, and we are not responsible for their acts, omissions, or availability.
The Service is provided for decision-support and education only and is not financial, investment, trading, tax, or legal advice. Please read our Trading Disclaimer & Risk Disclosure in full. The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular trading outcome.
To the maximum extent permitted by law, Hermetic Trader will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any trading losses or lost profits, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold Hermetic Trader harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. On termination, your licence ends and access may be removed; sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
We may update the Service and these Terms from time to time. If we make material changes, we will take reasonable steps to notify active subscribers. Continuing to use the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in British Columbia for any dispute, except where applicable law gives you the right to bring proceedings elsewhere.
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Service.
